Acceptance of Terms

By using Toastmaster.io, you confirm that you have read, understood, and agree to these Terms, along with our Privacy Policy and our Money Back Guarantee page (the "Refund Policy"), each of which is incorporated by reference. How we update these Terms is described in the section Changes to These Terms below.

Eligibility

You must be at least 16 years old to use the Service, and at least 18 years old, or the legal age of majority in your jurisdiction, to make a purchase. Visitors must be at least 16 years old to contribute content to a memorial page. By using Toastmaster.io, you represent and warrant that you meet the applicable requirement and have the legal capacity to enter into these Terms.

Your Account

Using the Service creates an account linked to the email address you provide. Access is granted through secure links sent to that address rather than a password, so keeping your email account secure is essential: anyone with access to your inbox can access your Toastmaster account. You agree to provide accurate information and are responsible for activity that occurs under your account. If you believe your account has been accessed without your permission, contact us at hello@toastmaster.io. We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or misuse the Service.

Communications

When you provide your email address, we use it to deliver your content, receipts, access links, and essential service messages. Where permitted by the law of your region, we may also send you a limited number of reminders and follow-ups about content you have started or purchased. Every such email includes an unsubscribe link, and opting out never affects delivery of your purchased content or essential service messages.

Description of the Service

Toastmaster.io provides AI-powered writing services, including but not limited to eulogies, obituaries, wedding speeches, and wedding vows, as well as memorial website hosting. The Service generates written content based on the information you submit. Memorial websites allow you to create and share a dedicated online tribute, including text, photos, and visitor contributions. You acknowledge that the Service relies on artificial intelligence and that output may vary in quality, accuracy, or tone. You are responsible for reviewing and editing generated content before using or publishing it, including checking that names, dates, and factual details are correct.

Pricing and Payment

Access to AI-generated text services requires a one-time payment at the price displayed at the time of purchase. Memorial website hosting is available through subscription plans (monthly or annual) or a one-time lifetime payment, with current pricing displayed at the time of purchase. The amount displayed at checkout is the total amount you pay. Payments are processed securely by our payment processor, Stripe; Toastmaster does not store or have access to your full payment details. Prices are listed in U.S. dollars unless explicitly stated otherwise, and you authorize us to charge the applicable fee at the time of purchase.

The contract between you and us is concluded when you complete checkout and receive our confirmation email. Before paying, you can review and correct your entries at checkout. These Terms are available in English on this page; we do not separately file the concluded contract, so please save or print a copy for your records.

Memorial Plans, Renewal and Cancellation

Monthly and annual memorial plans renew automatically at the end of each billing period at the then-current price until cancelled. You can cancel at any time through the billing portal linked from your memorial dashboard; cancellation takes effect at the end of the current billing period and no further charges are made. If we change a plan's price, we will notify you by email at least 30 days before the change applies to you, and you can cancel before it takes effect. Where mandatory law gives you an earlier termination right - for example, Danish law lets a consumer terminate an ongoing agreement after five months with one month's notice to the end of a month - cancellation takes effect then instead, and we refund the prepaid amount covering the period after termination.

When a plan is cancelled or a renewal payment ultimately fails, your memorial remains visible until the end of the period you have paid for, though new visitor contributions may be paused while a payment issue is unresolved. After the paid period ends, the page is unpublished and shows an unavailable notice. We retain the memorial's content for at least 90 days after it is unpublished so you can ask us to reactivate the plan or to export your content, in each case by contacting hello@toastmaster.io; after that period we may permanently delete it.

The lifetime plan means the operating lifetime of the Toastmaster memorial service, not a promise of perpetual operation. If we ever discontinue the memorial service, we will give lifetime plan holders as much notice as reasonably possible, and at least six months except where circumstances beyond our control prevent it, together with the ability to export their memorial content. If we discontinue the memorial service within five years of your lifetime purchase, we will also refund a proportionate share of the price you paid.

Refunds

We offer a full money-back guarantee for 14 calendar days from purchase, as described in the Refund Policy. The guarantee applies to your first payment for a given product; subscription renewals are governed by the cancellation rules in Memorial Plans, Renewal and Cancellation and by any mandatory rights you hold. If you are a consumer in the EU, EEA, or UK, you also have a statutory 14-day right of withdrawal from the day the contract is concluded; our guarantee matches this window, so requesting a refund at hello@toastmaster.io within 14 days always works the same way, and you may also use the statutory model withdrawal form, which we provide on request. Once a refund is issued, access to the purchased content is revoked.

Your Content and License to Us

You retain ownership of the content you submit or upload, including form answers, voice recordings, photos, and memorial content ("Your Content"). So that we can operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify and adapt for technical purposes (such as resizing, formatting, and creating thumbnails and previews), publicly display and perform, and distribute Your Content, with the right to sublicense to the service providers that run our infrastructure, solely for the purpose of providing the Service. This license ends when the content is deleted from the Service, except for backup copies retained for a limited period.

You represent and warrant that you own or have the necessary rights and permissions to everything you upload, including photographs, which are often owned by the photographer who took them; that you have the authority to create a memorial for the person it concerns; and that Your Content does not infringe any third party's rights, invade any person's privacy, or defame any person.

Memorial Pages and Visitor Contributions

A memorial page set to public is visible to anyone with the link and may appear in search engines; unlisted and password-protected settings are available. The memorial's owner controls its content and may moderate, approve, or remove visitor contributions at any time.

Visitors who contribute a tribute, story, or photo grant us the same license and make the same warranties as described in Your Content and License to Us, and grant the memorial's owner the right to display, moderate, and remove their contribution. Contributions must be respectful and truthful; contributions that are abusive, defamatory, or unrelated to honoring the person memorialized may be removed. We may remove any content or unpublish any memorial that we reasonably believe violates these Terms or any person's rights.

Content Complaints and Takedown

If you believe content on the Service infringes your copyright, defames you, or otherwise violates your rights or these Terms, notify us at hello@toastmaster.io with a link to the page, a description of the specific content, and the basis of your complaint. We review notices in good faith at our discretion and may remove or disable access to content.

Copyright notices under the U.S. Digital Millennium Copyright Act must include the information required by 17 U.S.C. § 512(c)(3) and may be sent to our Copyright Agent: Copyright Agent, Weblaunchy, Ørnegårdsvej 6, 1. 15, 2820 Gentofte, Denmark, or the email address above. If your content is removed following a copyright notice, we will take reasonable steps to notify you promptly, and you may submit a counter-notification meeting the requirements of 17 U.S.C. § 512(g)(3); where § 512(g) provides, we will restore the content unless the complainant informs us that it has filed a court action. We have adopted and enforce a policy of terminating, in appropriate circumstances, the accounts of repeat infringers.

Use Restrictions

You agree not to use the Service for unlawful, harmful, or abusive purposes; attempt to reverse engineer or exploit the Service or its AI systems; generate or upload content that is illegal, defamatory, hateful, or infringing; create a memorial for a living person without their consent, or for any person with intent to harass, deceive, or harm; impersonate any person; or resell, sublicense, or commercially exploit the Service itself without prior written permission. How you may use the content generated for you is described in Intellectual Property. We reserve the right to investigate violations and take appropriate action, including suspension or termination of access.

Intellectual Property

All rights, title, and interest in the Website, Service, branding, and underlying technology are owned by Toastmaster or its licensors. To the extent we hold any rights in content generated for you, we grant you a perpetual, worldwide, royalty-free, transferable license to use it for any purpose connected with the occasion it was created for: editing it, publishing it (for example in a newspaper, a funeral program, or on a memorial page), reading or performing it publicly, printing it, and sharing it. You may not use generated content to build or offer a competing service. You retain ownership of your original input content as described in Your Content and License to Us. If you submit feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free license to use such feedback for any purpose, including improving the Service.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted, error-free, or that generated content will meet your expectations or specific requirements. AI-generated content does not constitute professional, legal, medical, or financial advice. Nothing in this section limits warranties or remedies that consumer law grants you and that cannot be disclaimed.

Limitation of Liability

To the maximum extent permitted by law, Toastmaster shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or goodwill, arising out of or related to your use of the Service. In no event shall our total liability exceed the greater of the amount you paid to Toastmaster for the Service in the 12 months before the event giving rise to the claim and USD 100. Nothing in these Terms excludes or limits liability for gross negligence, intent, or any other liability that cannot be excluded or limited under applicable law, and nothing limits mandatory rights you have as a consumer.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Toastmaster from claims, damages, and reasonable costs, including legal fees, brought by a third party arising from Your Content, your unlawful use of the Service, or your infringement of a third party's rights, except to the extent the claim results from our own breach or negligence. Where you use the Service as a consumer, this section applies only to the extent such indemnities are permitted by the mandatory law of your country of residence.

Termination

We may suspend or terminate your access to the Service if you violate these Terms or misuse the Service. If we terminate your access, we will refund any prepaid amount covering the period after termination. Upon termination, your right to access the Service ceases; sections of these Terms that by their nature should survive, including licenses needed to wind down hosting, intellectual property, indemnification, limitation of liability, and governing law, survive termination. You may stop using the Service at any time and may request deletion of your account and content by contacting hello@toastmaster.io.

Service Availability and Changes to the Service

We are continuously improving the Service and may change, add, or remove features. We may suspend the Service temporarily for maintenance or security reasons. If we discontinue the Service or a material part of it, we will provide reasonable advance notice to affected paying customers and the ability to export purchased content, and the commitments made to lifetime plan holders in Memorial Plans, Renewal and Cancellation apply.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. If you are a consumer, you additionally enjoy any protections granted by mandatory law of the country where you reside, which may include the right to bring proceedings in your home courts. Disputes that cannot be resolved directly with us may be brought before the Danish courts. If you are a consumer in Denmark or the EU, you may also be able to complain to the Danish dispute resolution bodies under Nævnenes Hus (naevneneshus.dk). We encourage you to contact us at hello@toastmaster.io first - most issues can be resolved quickly and informally.

Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in the Service, in law, or in our business. For material changes that affect paid services or your rights, we will notify you by email at least 14 days before they take effect; plan price changes carry the longer 30-day notice described in Memorial Plans, Renewal and Cancellation. If a material change disadvantages you, you may cancel before it takes effect and receive a refund of any prepaid amount covering the period after cancellation. Non-material changes, such as clarifications, take effect when posted with an updated revision date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

General

If any provision of these Terms is held invalid, the remaining provisions remain in full effect. These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Service. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets, provided the assignment does not reduce your rights under these Terms; you may not assign them without our consent. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control. Our failure to enforce any provision is not a waiver of it.
